美國司法部去年起使用了新的死刑注射藥物「戊巴比妥」（pentobarbital），美國聯邦地區法院法官庫特莰（Tanya
Chutkan）13日指出，死囚可能會以新藥違憲為由起訴法院，要求暫緩執行死刑。美國哥倫比亞特區聯邦上訴法院（U.S. Court
of Appeals for the District of Columbia
Circuit）也表示不會如期進行死刑。但美國最高法院卻在今日淩晨以五票讚成、四票反對，同意死刑執行。
皮特森與其他兩名受害者家屬也於上週提起訴訟，要求法院考量武漢肺炎疫情帶來的健康風險，延後執行死刑，但還是無法阻止李遭處決。
